DA councillor Johann Brummer says he will seek a court order to force Bitou Municipality to hand over the information he says he needs to defend himself against the attempt to remove him from his seat.
Brummer said yesterday he had submitted a “partial” representation to Western Cape Local Government MEC Anton Bredell in response to Bitou’s demand that he be fired after being found guilty of contraventions of the Councillors’ Code of Conduct.
It dealt with only certain aspects of Bitou’s disciplinary process, as municipal manager Lonwabo Ngoqo “has refused to supply me with the transcripts ... and other documentation I require (for) a proper and comprehensive representation”.
A similar request to council speaker Lawrence Luiters was ignored.
Responding to ANC regional secretary Putco Mapitiza’s charge last week that the DA-led Western Cape administration had done nothing about removing him, Brummer said Bredell was unable to take a decision because Bitou had created obstacles.
His representation dealt with “the procedural validity of the action against me” and the “unsuitability of the presiding officer and prosecutor”. But without the documents, he could not address the merits of the case.
Bredell earlier said he had completed his probe into Bitou’s call but wanted Brummer to argue his side of the case before making a decision.
Brummer has called the hearing an act of vengeance as he was the whistleblower in the case in which fraud and theft charges were laid against ANC councillor Euan Wildeman and ex-manager George Seitisho.
